Courts will treat violators who previously broke illegal downloading laws more unfavorably than first-time offenders, even more so if they make a profit.
More specifically, the new rule punishes thieves with misdemeanors. The Michigan law also levies felony charges for repeat offenders and sentences them to up to five years in prison or jail. In Massachusetts , illegal downloading laws depend on how many files you install. Others, meanwhile, may have stricter or lighter punishments that apply to specific acts, as is the case in Michigan.
Is piracy a felony under state laws? That has a lot to do with where you live, especially if the state government is also filing charges against you. Because of this, felons must consult with an attorney who thoroughly understands local and federal piracy laws.
Your defense depends on whether you are currently facing charges or if you are a currently housed inmate.
Finding evidence in a piracy case is even more challenging. More specifically, prosecutors must show that you downloaded the content and provide evidence that tracks the action back to your IP address or account. To add to that, they must do so without illegally obtaining information about you. Under the Fourth Amendment of the United States Constitution, accusers must obtain a warrant from a judge.
This rule certainly applies to digital data. In short, even if the prosecutors prove that you illegally downloaded a song or movie, their case will fall short when they violate the Fourth Amendment and gather information about you without a search warrant. This scenario requires you to focus on having the charges and fines for illegal downloading reduced.
As mentioned earlier, accusers will ask for compensation that makes up for the lost income. In addition, they will attempt to make you pay for each record after you download songs illegally or install pirated versions of videos. If you show that you only downloaded the material for personal use, the amount that you have to compensate the record holder with may significantly drop.
Secondly, identify the platform that you used to download the music or videos. For example, if the content was on YouTube, the prosecutor will only make cents in ad revenues each time you play the song.
Because of this, their lost income from YouTube or other ad-paying platforms will be relatively small. However, if you download songs illegally from sources that require you to pay such as iTunes , then they may ask you to pay them back the cost of each song.
Above all else, you should make sure that everything is organized and well-documented. After all, the longer the case becomes, the more legal expenses and damages that you have to incur. In certain circumstances, you may still defend yourself even if the evidence of piracy is strong.
Under United States federal law, the statute of limitations on copyright infringement is only three years. That is to say, prosecutors cannot sue you if you illegally downloaded a song or movie more than three years ago.
Equally as important, you may rely on the fair use doctrine as a defense. However, this is only the case if you used the copyrighted content for educational or informative purposes.
The fair use doctrine is exempt from illegal downloading laws. Yet keep in mind that you need to provide sufficient evidence that you used the copyrighted material for an educational or charitable purpose.
But is it really illegal? Well i guess, but i would like to see what people think, is the the cracks that people are against? I guess i have a lot to say on this topic… Well about the email accounts, even if people get into other email accounts its an invasion of privacy, makes the person look like a hacker. However to the people who want it stopped, it is going to be nearly impossible to stop this completely.
And in the case of the boyfriend in jail, it is not completely fair to have him in there because if he is arrested, then all the other people who download illegal software should be arrested and put in jail.
Each developed country would have to arrest its own governments!!! There would be no one left innocent. If u get caught your a loser i guess i think its bs, me and about 15 of my mates have been downloading music for 10 years about 50 to mp3s a day. Hi I just got a letter from my internet provider that I have illegaly downloaded music movies etc files. I only download music from limewire and itunes and I downloaded some movies from vuze and I payed for the program so why would I get introuble?
I agree with Dave, it is true and a violation of privacy. Just checking that deleting downloads wont stop you getting prosecuted. Shannon, really? Then how do you suggest that artists, musicians, producers, etc ever get paid? If you must download illegally, consider being part of a newsgroup. Can I get into legal trouble for cracking my boyfriends password to his email.
I mean it was his birthday. Thank you :. I think I may have. Could still get in trouble. Probably not liable. Most spyware is installed by the file-sharing program itself, like KaZaA! Personally I wish we could end music piracy because that would mean more money for artists, and more and better music all around as a result, but I also believe that software code including code for p2p programs that enable music piracy is protected by the First Amendment.
Your email address will not be published. February 15, at pm. I'd assume most cracked copies would be floating around the internet, which if downloaded, would negate any validity. For example- if I bought Winblows 7, installed it, put the physical copy near the desktop and then, for some reason, my computer exploded, also melting the physical copy. I'd then download the first pirated copy I found not on the same computer, obviously. This newly downloaded copy wouldn't be the same untouched copy I obtained legally.
It might depend on jurisdiction, but in general , while it may be moral, it is still illegal unless you get permission to do this - which I assume you don't have from the company who owns the rights. Sign up to join this community.

It is possible to serve time in a prison for downloading a film, music, or other item illegally, but most areas recognize that this punishment does not fit the crime.
In most cases, a very high monetary fine will be imposed, but no jail time will be demanded. Even so, when Internet piracy can possibly result in jail time, it is very important to obey the law even if the chances of being prosecuted are minimal. Fines, where they exist, are often extremely inflated and can reach more than a hundred thousand times the purchase price of the individual song or film. In some areas, a person can be sent to prison for illegal downloading.
